What Is Private Judging?

Private judging is a form of alternative dispute resolution. The California Constitution grants parties the authority to select a qualified lawyer or retired judge to act as a private judge. This judge performs essentially the same services as a public judge, handing down an order when parties cannot reach an agreement on their own.

Is A Judgment By A Private Judge Binding?

Yes. After parties have selected a private judge, they execute a Stipulation for Appointment of Private Judge, which is signed by the parties, their counsel and the chosen judge. This document is then filed with the court where the case is pending. When the presiding judge of that county signs the agreement, the private judge is vested with all authority of a judge appointed to a Superior Court, for that case only.
